CareSponsors, LLC, a Michigan limited liability company ("CareSponsors") is making this website (the "Site") available subject to these Terms of Use. You are prohibited from using this site if you are not 18 years of age or older.

CareSponsors will not be liable to you for any damages or losses you sustain based on content that you access from any other website. In addition, a link to any other website does not imply that CareSponsors endorses or accepts any responsibility for the content or use of such other website. 7. Limitation of Liability.
Neither CareSponsors nor its officers, directors, employees, agents, successors, or affiliates, nor any third party involved in any trading or delivering the Site will be liable under any theory (including negligence) for any incidental, consequential, indirect, special or punitive damages arising out of your access to or use of the Site or your inability to use the Site even if CareSponsors has been advised of the possibility of such damages. In any event, CareSponsors' total liability under any theory arising out of the Site or its use is and shall be limited the maximum amount of funds in your Brokerage Account.

CareSponsors is concerned about privacy matters for Participants. Please review our Privacy Statement. 

9. Indemnity.
By using the Site, you agree to indemnify CareSponsors, its officers, directors, employees, successors, agents, and affiliates for any and all claims, damages, losses, and causes of action (including reasonable attorney fees and court costs) arising out of or relating to your breach or alleged breach of this Agreement (including, without limitation, claims made by third parties for infringement of intellectual property rights) or for any content that is provided by you (or through your user name and/or password). You agree to cooperate as fully as reasonably required in CareSponsors defense and/or settlement of any claim. CareSponsors reserves the right to assume the exclusive control over the defense and settlement of any matter subject to indemnification by you.

12. Jurisdiction.
CareSponsors operates this Site from its offices within the United States. These Terms of Use will be governed by the laws of the State of Michigan as applied to contracts entered into between Michigan residents and performed in Michigan. Any dispute arising out of these Terms of Use or your use of the Site will be heard only in the State or Federal Courts located in Kent County, Michigan and you hereby consent and submit to the personal jurisdiction of such courts. If any provision of these Terms of Use is held to be unlawful, void, or for any reason, unenforceable, that provision will be deemed severable and will not effect the validity and enforceability of the remaining provisions. These Terms of Use and the Participant's Agreement to the extent that use of the Site involves your CareSponsors Account, state the entire agreement between the parties relating to the use of the Site. The Terms of Use may not be amended except as provided above.

13. Comments, Complaints, and Questions.
We welcome your feedback about the Site. However, any comments, ideas, notes, messages, suggestions, or other communications sent to the Site shall be and remain the exclusive property of CareSponsors and we may use all such communications in any manner, including reproducing, disclosing and publishing such communications, all without compensation or notice to you. Any communication or material you transmit to the Site by electronic mail or otherwise is, and will be treated as, non-confidential and non-proprietary.
